Introduction

The following Terms and Conditions control your membership in the CreateSplashPages.com program. You agree that you have read and understand this Agreement ("Agreement") and that your membership in the CreateSplashPages.com program (the "Program") shall be subject to the following Terms and Conditions between you (the "Member") and CreateSplashPages.com. These Terms and Conditions may be modified at any time by CreateSplashPages.com. Please review them from time to time since your ongoing use is subject to the terms and conditions as modified. Your continued participation in CreateSplashPages.com after such modification shall be deemed to be your acceptance of any such modification. If you do not agree to these Terms and Conditions, please do not register to become a member of CreateSplashPages.com.

Terms of Participation

Member must be 18 years of age or older to participate. Members must provide CreateSplashPages.com with accurate, complete and updated registration information, including an accurate name, mailing address and E-mail address. Any inaccurate information may result in the users account being removed.

To the full extent allowed by applicable law, CreateSplashPages.com at its sole discretion and for any or no reason may refuse to accept applications for membership.

Members may NOT (i) activate or use more than ONE Member account; One account per person only!; (ii) select or use an E-mail Address of another person; (iii) use a name subject to rights of another person without authorisation from that person; (iv) use a false or misleading name, mailing address, ip address or E-mail address(including disposable) to activate or use a Member account.

By signing up for CreateSplashPages.com, Member is opting-in to receive admin E-mails from CreateSplashPages.com. If you do not wish to receive these E-mails, you may cancel your account anytime. Members must NOT use a system that prohibits CreateSplashPages.com from contacting them regarding their account.
Members may 'Unsubscribe' to receive other special offer E-mails from admin inside the members area.

CreateSplashPages.com reserves the right to track Member's activity by both IP Address as well as individual browser activity.

CreateSplashPages.com has the right, in its sole discretion, to suspend or cancel, at any time and for any or no reason, a Member's membership in and access to the CreateSplashPages.com Website and the CreateSplashPages.com program. All Earnings may be cancelled in CreateSplashPages.com sole discretion, and the Member may be referred to appropriate law enforcement agencies if such action is deemed warranted by CreateSplashPages.com.

Member agrees not to abuse his or her membership privileges by acting in a manner inconsistent with this Agreement. Member agrees not to attempt to earn through other than legitimate channels authorized by CreateSplashPages.com. Member agrees not to participate in any fraudulent behavior of any kind.

CreateSplashPages.com shall be the sole determiner in cases of suspected abuse, fraud, or violation of its rules. Any decision CreateSplashPages.com makes relating to the cancellation of Earnings and the termination of membership shall be final and binding.

Spamming is strictly prohibited. Any spamming done to advertise CreateSplashPages.com will result in immediate termination of your account and a forfeiture of your account balance. Incidents will be dealt with on a case by case basis.

Member's discontinued participation in the CreateSplashPages.com program or failure to notify CreateSplashPages.com of any address (mailing or E-mail) changes may result in the termination of Member's membership and forfeiture of Member's unredeemed Earnings.

Member shall comply with all laws, rules, and regulations that are applicable to Member. Member acknowledges that Member may only participate in the CreateSplashPages.com program if and to the extent that such participation is permitted by such laws, rules, and regulations.

If member objects to any of the Terms and Conditions of this Agreement, or any subsequent modifications to this agreement, or becomes dissatisfied with the Program, Member's only recourse is to immediately discontinue participation in the CreateSplashPages.com program and properly terminate his or her membership.

Upgrades
Upgraded members can add additional images and make more pages, these extra images/pages are NOT removed when a member downgrades, However after downgrading more than 3 times the members extra pages will NOT show. This is to prevent abuse of our Upgrade system.
Re PayPal Invoices: Members who do not renew their invoices after 5 days will have their accounts downgraded until the invoice is cancelled. To cancel simply E-mail admin and request the invoice gets cancelled.

Upgrades Members E-lists
Upgraded members have more pages with built in forms for E-mail marketing. Any member who tries to bypass or abuse this system, either spamming members of the public or adding details (names/E-mails) to more than the list requested by the member of the public, will be removed from our system, regardless of upgrade date/status, spam is strictly prohibited!

MEMBER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT MEMBER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, CreateSplashPages.com EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED BY LAW, CUSTOM OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. However, no data transmitted over the Internet can be 100% secure. As a result, while CreateSplashPages.com strives to protect its Members personal information, CreateSplashPages.com cannot guarantee the security of any information that Members transmit to or from the participating advertisers/merchants and Member does so at his/her own risk.

This Agreement constitutes the entire Agreement between Member and CreateSplashPages.com in connection with general membership in the CreateSplashPages.com program and supersedes all prior agreements between the parties regarding the subject matter contained herein. If any provision of this AGREEMENT is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of this AGREEMENT will remain in force. No failure of either party to exercise or enforce any of its rights under this AGREEMENT will act as a waiver of such rights.

Members must NOT create pages that advertise any porn, pyramid, ponzi schemes, add links to auto-download of viruses or malware or any other illegal activity. Any pages found to be in violation of this agreement will be removed without notice and could possibly result in account removal.

Members of the public:
Any purchases made through any of our members created pages (../splash.php?id=???? or ../splashtrk.php?id=????) are made by the purchasers sole discretion. CreateSplashPages.com are not associated with any 3rd party that ask for payments directly. CreateSplashPages.com will not get involved with any 3rd party disputes. The member of the public must go through the appropriate Payment processors procedures if any 3rd party dispute is created from a 3rd party purchase.
